TRADEMARK LAW

We advise clients on the selection of marks including the protectability of marks, and the pros and cons of selection of descriptive vs. distinctive marks. We advocate thorough searching for availability prior to adoption, and render opinions based on in depth experience in a number of industries. We register our clients' marks and maintain them with a state of the art docket.

We search both domestically and internationally, and keeping in mind the client and its interests, advise with respect to registration strategy, risks and costs. We strive to keep our clients infringement free and we assert their rights against infringers with equal zeal. We have in depth experience in foreign practice and the strategy of international expansion of rights.

We have substantial experience in litigation and prosecute Trademark Trial and Appeal Board cases. Where possible we strive to achieve negotiated settlements in order to minimize costs to the client and achieve the client's goals. We protect the clients' marks here and abroad.

Joan is one of only 57 mediators sanctioned by the International Trademark Association, and has experience in mediation and expert witnessing in trademark disputes. She has many years of problem solving experience in the intellectual property area.

COPYRIGHT LAW

Copyright law can be a snare for the corporate client. We assist our clients in obtaining the proper assignment of rights, to minimize likelihood of litigation, and advise on the enforcement and defense of copyright cases. We obtain copyright registrations and do copyright searches to determine ownership of protected works.

We will audit copyright rights, assist in the analysis of a client's copyright portfolio, and advise on proper notices.

LICENSING AND AGREEMENT NEGOTIATION AND PREPARATION

We have negotiated and prepared every sort of license having to do with intellectual property rights. We have done biomedical research collaboration and licensing agreements, trademark and copyright licenses, sports figures endorsement licensing, software licenses, technology transfer agreements of various sorts, production agreements for the placement of live shows, artist's performance agreements, sculptural works agreements and rights of publicity and promotional licenses and waivers. We have prepared and implemented idea submission procedures and confidential disclosure agreements and systems for a number of clients to minimize risk.

PORTFOLIO AUDITS AND ASSESSMENT

We welcome the opportunity to review with you the status of your intellectual property portfolio, and to make suggestions and recommendations for its enhancement and security.
